In case of obstruction of the activities of exporting enterprises by empowered executives in the regions will be recognized as unacceptable

    Reducing administrative barriers for exporters is one of the important activities of reforming foreign economic activity.

    Meanwhile, analysis showed current situation on places demonstrates that in order to increase export performance, a certain number of executives in the regions put artificial barriers for exporters.

    For instance, in the process of transporting products from one region to another, there are cases arise when officials prevent exporters from other regions from crossing territories or require registration in the territory from which the business entity exports products.

    It should be noted that the entire territory of the Republic of Uzbekistan is considered as an integral market, and the free movement of goods (products) and services in the republic is one of the main principles of a market economy. Alterations in regional export indicators do not affect the country's overall development indicators.

    The above-mentioned artificial barriers contradict the requirements of the current regulation.

    The legislation of the Republic of Uzbekistan should be applied equally on the entire territory of the Republic of Uzbekistan.

    Export-import operations are regulated by the Customs Code and other normative acts.

    The import of products into the territory of the Republic of Uzbekistan and export from the territory may be prohibited only in accordance with the legislation of the Republic of Uzbekistan and international treaties.

    State bodies and their officials do not have the right to interfere in entrepreneurs activities.

    Moreover, according to the Resolution of the President of the Republic of Uzbekistan (№. RP-3978-10.17.2018), khokims (local mayors) and executives of regional departments of state bodies were warned on their personal responsibility in case of preventing the export of fruits and vegetables regardless of the territorial affiliation of the exporter.

    The imposing of restrictions and requirements which are not stipulated by the law related to entrepreneurial activity, in particular, to exports, may be regarded as abuse of power or official authority (article 205 of the Criminal Code of the Republic of Uzbekistan) or abuse of power or official authority (article 206 of the Criminal Code of the Republic of Uzbekistan) and officials who allowed this violation, can be prosecuted.
