It was noted that systematic work is being carried out in our country to ensure reliable protection of the inviolability of private property rights and to limit illegal interference of state bodies in property relations.
In particular, the Constitution stipulates that no one can be deprived of their home except by a court decision and in accordance with the law, and the owner deprived of his home is provided with preliminary and equivalent compensation for the cost of housing and the losses incurred by him.
The ongoing reforms aimed at protecting the inviolability of private property and rights to it require bringing some legislative acts of the Republic of Uzbekistan in accordance with the Constitution in a new version.
The draft law provides for the introduction of appropriate amendments and additions to the Housing Code and the Law "On Procedures for the seizure of land for public needs with compensation."
In particular, article 11 of the Housing Code provides for modification of the appearance of residential buildings, their reconstruction or demolition are carried out in accordance with the legislation on urban planning. In practice, it was allowed to change the appearance of residential buildings, rebuild or demolish them with the appropriate permission of local government authorities.
It is also determined that no one can be deprived of housing without a court decision and in a manner contrary to the law, and the owner, the owner deprived of housing, is guaranteed in advance and at equal cost compensation for the cost of housing and damage caused to it in cases and in accordance with the procedure provided for by law.
The adoption of this draft law will serve to ensure the unconditional implementation of the new version of the Constitution, the protection of private property and guarantees of the rights of owners by compensating, in accordance with the established procedure, the owner deprived of housing, the cost of housing and property, as well as the damage suffered by him in accordance with the established procedure.
