The law "On Subsoil" was adopted in a new edition

    The President of the Republic of Uzbekistan signed the Law dated 31.10.2024 No. ZRU-987 "On Subsoil", which will enter into force in three months.

    The Law regulates relations arising from the possession and disposal of mineral wealth, as well as the use and protection of mineral resources.

    The subsoil and all minerals naturally occurring in the subsoil are the state property of Uzbekistan, are subject to rational use and are protected by the state. Subsoil plots cannot be the subject of purchase and sale, donation, inheritance, deposit, pledge and cannot be alienated in any other form.

    The new version of the law provides for direct action rules governing relations in the field of subsoil use.

    In the process of issuing permits for the use of mineral resources, the principle of a "single window" is being implemented. A mechanism is also being introduced that allows licensees to dispose of permits for the right to use subsurface areas, including their sale, pledge or transfer to other persons under the control of a state body.

    The document improves the norms of property law for geological information, its exchange and implementation by investors. Special attention is paid to hydrocarbons, for which standards have been tightened and detailed in accordance with international practice.

    The procedure for issuing permits for geological exploration and extraction of non-metallic minerals has also been established. The rights and obligations of subsoil users with permits, reporting requirements and minimum annual costs for geological exploration and mining are defined.

    Bodies implementing state policy in the field of subsoil use and protection:

    • Cabinet of Ministers of the Republic of Uzbekistan;
    • Ministry of Mining and Geology;
    • Ministry of Energy;
    • Ministry of Ecology, Environmental Protection and Climate Change;
    • Inspection for control in the field of mining and geology;
    • State institution "Center for the Use of Mineral Resources";
    • local executive authorities.

    The document has been published in the National Database of Legislation and will enter into force on 02.02.2025, Norma reports.
