The issues that are planned to be considered at the next plenary session of the Senate were discussed at the meeting in advance.
In particular, the senators paid attention to the Law "On Advertising" in the new edition. It was noted that the reason for committing a large number of offenses in law enforcement practice is the presence in existing legislative acts of norms that are not valid and have a general character, not fully covering relations related to advertising activities.
In 2021 alone, 15,486 violations in the field of advertising were revealed. Thus, 10,249 cases of violations in outdoor advertising and other types of advertising have been registered, 3,416 cases of violations are related to advertising and ads on trees, 658 - with advertising of medicines and biologically active additives, 499 - with advertising of tobacco products and alcoholic beverages, 260 - with advertising of bookmakers and sweepstakes, 150 - with advertising on cultural heritage sites, 110 - with advertising in private educational and medical institutions, 103 - with advertising in stimulating contests and promotions.
The new version of the Law also includes the norms of by-laws.
The law, based on the analysis of practice and foreign experience, provides for norms concerning the organization and conduct of actions that stimulate advertising. In particular, it is prohibited to conduct incentive promotions without an appropriate prize fund.
It is established that advertising can be distributed in the state language on the territory of the Republic of Uzbekistan, in addition, its translation can be in other languages.
Based on legislative and law enforcement practice, as well as foreign experience, the requirements for advertising are being strengthened and new norms are being introduced.
In particular, it is prohibited to place advertisements in textbooks and notebooks, to indicate prices for advertising in foreign currency, to use forms, expressions and images that contradict generally accepted norms of behavior and spirituality, to conceal information about the basic properties of the product from the consumer.
The peculiarities of advertising distribution by means of certain types of advertising are also determined. In particular, the total duration of advertising broadcast on TV channels may not exceed 20% per hour, but not more than 15% per day. It is not allowed to interrupt with advertising and show TV shows with a duration of less than 10 minutes together with advertising.
Another important aspect of the Law is the ban on advertising breast milk substitute products.
During the discussion, the senators also drew attention to cases related to the implementation of certain articles set out in the Law.
The meeting also heard information from the Director of the Anti-Corruption Agency on the work done to ensure the openness of the activities of state bodies and organizations.
The conducted studies and analysis of the activities of state bodies and organizations to ensure their openness have shown the presence of untapped opportunities and pending issues in this area.
In particular, the Anti-Corruption Agency has not developed a methodology for monitoring and evaluating the openness of the activities of state bodies and organizations. As a result, the work on determining the index of openness of the activities of state bodies and organizations has not been completed.
A separate instruction has not been developed reflecting the form, time, and order of placement on official websites and the open data portal (data.egov.uz ) information that is open and subject to constant publication.
Analysis in the context of state bodies and organizations shows that often the necessary information is not posted by the Ministry of Culture, the Ministry of Health, the Ministry of Employment and Labor Relations, the State Forestry Committee, the Cultural Heritage Agency, the khokimiyats of Khorezm, Navoi, Samarkand and Bukhara regions.
